Information on the use of the right of withdrawal

Right of withdrawal

  • You have the right to withdraw from this contract within 14 (fourteen) days without giving a reason.
  • The exercise of the right of withdrawal ends after 14 days, starting from the day on which you or a third party whom you have designated or authorized to receive the goods by providing the order code, and who is not the carrier, received the goods for their use.

  • In order to comply with the withdrawal period, it is sufficient to send your application for the use of the withdrawal right before the end of its validity.

Consequences of withdrawal

  • If you withdraw from this agreement, we will refund all payments received from you, without undue delay and in any event no later than 14 days after the day on which we are informed of your decision to withdraw from this agreement. The refund will be made using the same payment method that you used for the initial transaction, unless another payment method has been expressly agreed upon. In any event, you will not be charged a fee in connection with this refund. We may withhold payment until we receive the goods back or until you provide proof that the goods have been sent back, whichever is earlier.
  • You must contact us by e-mail at info@maxtrade.lv without undue delay and in any event no later than 14 days after the day on which you notify us of your decision to withdraw from this contract. The deadline will be met if you send the goods back before the end of the 14-day period.
  • You are liable for any reduction in the value of the goods if the goods are used for purposes other than those related to their properties. For example, the product(s) is technically and visually damaged, used and/or worn out (the product or its component, part) by more than 5% (five percent), for example, such products as perfumes, eau de toilette, toners, cartridges, creams, non-rechargeable batteries, batteries, coffee grinders for coffee machines, dust collectors for vacuum cleaners and other similar products and their parts.
  • The consumer is responsible for maintaining the quality and reliability of the product during the period of exercise of the right of withdrawal (including for the complete and impeccable preservation of the packaging).

The consumer cannot exercise the right of withdrawal:

  • in the cases established by the Cabinet of Ministers on 20.05.2014 of Rules No. 225 "Rules for Distance Contracts", in paragraph 22, including if:
  • the price of the goods depends on fluctuations in the financial market that the seller cannot control and that may occur during the period of the right of withdrawal;
  • the goods are manufactured according to the instructions and request of the consumer or they are personalized;
  • the goods are perishable or their expiration date is soon;
  • the consumer opened the packaging of the goods that cannot be returned for health and hygiene reasons, for example, such goods as an electric toothbrush, epilator, electric beard trimmer, hair trimmer, electric hair clipper, multicooker, in-ear audio headphones, Bluetooth headphones and other similar goods, if the packaging of these goods is open and/or the protective seal is damaged;
  • if after delivery, due to the properties of the goods, they are irreversibly mixed with other things;
  • the consumer has requested the seller or service provider to come and carry out urgent repairs or maintenance work. If the seller or service provider, upon arriving at the consumer, provides additional services or delivers goods that are not necessary spare parts for repairs or maintenance work, the right of refusal applies to the said additional services or goods;
  • upon receiving the goods from the courier, please make sure that the packaging is not damaged. If such damage exists, be sure to indicate it in the act of acceptance of the goods from the courier. Please note that if the presence of a packaging defect is not recorded in the acceptance certificate at the time of receiving the goods, we will not be able to consider your claim for damage to the packaging and the goods in it in the future;
  • if the packaging was not damaged, but upon opening it, you discovered that: 1. the goods have external damage (for example, the screen or case is broken); 2. the parts specified in the kit are missing (for example, the blender does not have a chopper blade, there is no charger for the laptop), then, within three days after receiving the goods you can exercise your right of refusal and make a claim to us. Unfortunately, all claims submitted after this deadline will not be considered;
  • the consumer opened the packaging of an audio recording, video recording or computer program;
  • an agreement has been concluded for the delivery of digital content that is not delivered on a permanent storage medium, if the delivery of digital content has been initiated with the prior express consent of the consumer and confirmation of the loss of the right of refusal;

When returning a product purchased in a retail store, you must also return the original cash receipt and service card.

Procedure for handling complaints
A complaint is considered within 15 days from the date of receipt of the complaint, a response is sent to the address specified in the complaint. If the complaint is found to be unfounded and you do not agree with this decision, you have the right to use alternative dispute resolution options specified in the regulations by submitting a written application to the seller of the goods for pre-trial dispute resolution, indicating the name, surname, contact information, date of filing the application; the essence of the dispute, the requirements and their justification.
